Citadel claims $1.2 billion in damages
(click on link above to read article) After Measure J won, Citadel Exploration filed a claim against San Benito County for $1.2 billion in damages. This is a "takings claim". Our attorneys are confident that Measure J will stand up to legal challenges. Measure J is based on the well-established legal theory that local governments in "home rule" states can use zoning and land use to regulate industrial activities -- like oil and gas operations. This legal theory has been upheld by New York state's highest court, which ruled recently that New York communities can ban fracking. Like New York, California is a "home rule" state. |
